The WIPO Negotiations on the Protection of Traditional Knowledge and Traditional Cultural Expressions Move Towards Clearer Objectives for the International Instrument

The 53rd session of the World Intellectual Property Organization (WIPO) Intergovernmental Committee on Intellectual Property and Genetic Resources, Traditional Knowledge and Folklore (IGC) in September 2026 moved past a long textual standstill by agreeing to changes to the draft texts on traditional knowledge and traditional cultural expressions, including a new proposed formulation of objectives. This progress reflects growing alignment among the African Group, the Asia-Pacific Group, the Group of Latin American and Caribbean Countries (GRULAC) and Indigenous Peoples and local communities, with the Like-Minded Countries playing an important role as a cross-regional group. Building greater convergence among them, in particular on the obligations the instrument will create, will be important ahead of the 2027 WIPO Assemblies.

Building Up a Balanced Global Intellectual Property System: Report of the WIPO Assemblies’ Sixty-sixth Series of Meetings

This report reviews the key discussions and outcomes of the 66th Series of Meetings of the World Intellectual Property Organization (WIPO) Assemblies held in July 2025. The Assemblies addressed important governance, oversight, and norm-setting issues. Key developments included the launch of the process to appoint a new Director General, decisions on committee compositions and approval of the 2026/27 Program and Budget. Developing countries advocated for more inclusive participation in governance, balanced priority setting on norm-setting work, and stronger implementation of the Development Agenda.

South Centre Statement to the WIPO Intergovernmental Committee on IP, Genetic Resources, Traditional Knowledge and Folklore 51st Session

Read our statement on the future of the work by the WIPO Committee on IP, Genetic Resources, Traditional Knowledge and Folklore, following the conclusion of the WIPO GRATK Treaty. Viable options for an international legal instrument or instrument(s) on TK/TCEs are emerging with greater clarity. A final timeline for conclusion would support the negotiation process, with a date set for a Diplomatic Conference in the next biennium.

Statement by the South Centre to the WIPO Intergovernmental Committee on Intellectual Property, Genetic Resources and Associated Traditional Knowledge
South Centre is participating in the textual based negotiations in WIPO on the protection of traditional knowledge and traditional cultural expressions this week at IGC50 chaired by DPR of Brazil, Erika Watanabe Patriota. International rules are needed to protect the interests of indigenous and local communities and prevent misappropriation.

A Breakthrough in Negotiations on Intellectual Property, Protection of Genetic Resources and Traditional Knowledge in WIPO?

This Policy Brief provides a brief summary of the current negotiations in the World Intellectual Property Organization (WIPO) for an international legal instrument or instruments relating to intellectual property to ensure the balanced and effective protection of genetic resources (GRs), associated traditional knowledge (TK) and traditional cultural expressions (TCEs). The General Assembly in June 2022 took a significant decision to schedule a Diplomatic Conference in 2024 to conclude a treaty on the protection of GRs and associated TK. However broader protection for TK and TCEs is not part of the decision. The 44th session of the WIPO Intergovernmental Committee on Intellectual Property and Genetic Resources, Traditional Knowledge and Folklore (IGC), held on 12–16 September 2022, focused on advancing text-based negotiations on these issues and two more sessions will follow. Developing countries must coordinate closely, in parallel to the IGC sessions, to agree on a common negotiating position for the treaty to be concluded no later than in 2024.
