Trade and Investment Agreements—Barriers to National Public Health and Tobacco Control Measures.
An arbitral tribunal is expected to issue soon a decision on jurisdictional matters in a case brought by Philip Morris against the government of Uruguay. The claim, based on a bilateral investment treaty (BIT) between that country and Switzerland, challenges packaging and labeling requirements for cigarettes adopted by Uruguay to reduce tobacco’s consumption. Rethinking The R&D Model for Pharmaceutical Products: A Binding Global Convention.
The current incentive-based model of pharmaceutical R&D has failed to make needed medicines available to a large number of people, especially those living in developing countries. This Policy Brief recognizes the urgent need of shifting from the incentive-based model of R&D to a model that effectively promotes not only innovation but more importantly access to medicines, particularly for diseases that disproportionately affect developing countries. The Staggering Rise of the South?
This paper argues that the unprecedented acceleration of growth in the developing world in the new millennium in comparison with advanced economies is due not so much to improvements in underlying fundamentals as to exceptionally favourable global economic conditions, shaped mainly by unsustainable policies in advanced economies. The only developing economy which has had a major impact on global conditions, notably on commodity prices, is China. (more…)

This Note is an analysis of the draft waiver decision submitted by the Chairman of the CTS to Ministers for adoption at the 8th Ministerial Conference. This is essentially a waiver from the most-favoured nation treatment clause (Article II. 1) in GATS to allow Members to provide preferential and more favourable treatment to services and services suppliers of LDCs. LDC Package: State of Play and Proposed Language for WTO’s MC8.
The LDC Package was proposed by the WTO Director General, in his capacity as Trade Negotiations Committee (TNC) Chair in May 2011 for early harvesting at the Eighth Ministerial Conference (MC8) in December 2011. Trade has been at the centre of discussion of LDCs improving their economy and social conditions. It was said that LDCs are not integrated into the world economy; that is why they are marginalized. This is not true. Many LDCs have higher exports to GNP ratio than some developed countries. (more…)
